These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you should not use or access this Website.

The Babystore Ltd is committed to:

Access
You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration
You warrant that:

  • The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

  • You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use

We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation.

When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, email address, billing address, delivery address, telephone number, product selections, credit card or other payment information. We may also collect, and our third party providers of advertisements and content may collect, information about where you are on the internet (eg the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website (“User Information”). We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the registration we have with the Data Commissioner’s Office.

You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your Personal Information and /or User Information we are entitled do so.

We use Cookies to keep track of your current shopping session to personalise your experience and so that you may retrieve your shopping cart at any time – if you do not accept Cookies you will not be able to use this Website.

Indemnity
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Our Rights
We reserve the right to:

  • modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
  • change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website

 

 

PURCHASE OF PRODUCTS

Orders
All orders are subject to acceptance in accordance with our Order policy.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

The % off promotions the website runs from time to time require a minimum basket spend of £100 unless confirmed otherwise  and apply to new orders only and cannot be backdated.

Where a brand is excluded from discount offers, we will cancel any orders incorrectly accepted by the online system and refund the transaction.

Contract Creation and Electronic Contracting
The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the web-site by pressing the confirm order button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the web-site
  • We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from The Babystore Ltd
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions in How to Cancel Your Order

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock
  • Our inability to obtain authorisation for your payment
  • The identification of a pricing or product description error
  • You not meeting the eligibility to order criteria set out in the main Terms and Conditions

The contract will be concluded in English.

The details of your specific contract will not be filed by The Babystore Ltd.

 

Contract Cancellation
Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right no longer than eight working days after the day on which you receive the Products. There may be charges associated with cancellation and/or return of the Goods, please contact store for details.

Description of Products
Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order policy.

All products listed upon the website are done so as an Invitation to Treat.

We reserve the right to alter specifications without prior notice. All sizes and weights given as a guide only and are approximate. Representations of colour are approximate due to the limitations of photographic and calibrations of different output devices.

 

Gift Vouchers

We cannot exchange vouchers for money or accept returned vouchers
Conditions of use:
1. This voucher can be used on this website.
2. This voucher can only be exchanged for goods.
3. This voucher can only be exchanged for goods of equal value, or as part payment for goods of a higher value than it’s face value.  This voucher cannot be exchanged for cash, and change will not be given if it is exchanged for goods less than its face value.
4. This voucher cannot be used for the settlement of credit card accounts.
5. The Baby Store Limited, shall not be liable in the event of any vouchers being lost, damaged or stolen.

 

Payment
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the Products ordered plus delivery charges as set out in the delivery section of this Website. Payment can be made by any of the methods specified in the payment section of this Website and payment will be debited and cleared from your account as set out in the Payment section of this Website.

You confirm that the credit, debit or store card that is being used is yours.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

All card payments are processed for you by SagePay or PayPal. The balance is paid to The Babystore Ltd. The total amount you pay is the same regardless of the payment method.

Refusal of Transaction
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must:

  • Register by providing your real name, phone number, email address, payment details and other requested information
  • Be over 18 years of age
  • Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
  • Possess a valid credit or debit card issued by a bank acceptable to us

By making an offer to buy a Product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

Special Promotions and Offers
Any special promotional offers made available on this website cannot be used in conjunction with any other special offer, promotional or voucher based discounts.

 

Baby Savings Club

Product price is fixed when 40% of the online price for the item has been paid;

e.g Product price £770, when £308 has been paid the price is held at that shown online, the balance of £462 can be paid in instalments

The total amount paid for items shall be the cost confirmed in email from The Babystore when the 40% value has been reached. We do not charge interest for items purchased through the Baby Savings Club.

If you choose to change the item(s) ordered we cannot be held liable for items being out of stock at short notice but will do our utmost to accommodate your requirements. Where a product becomes unavailable from a supplier or is delayed we reserve the rights to offer a suitable alternative or refund.

 

GENERAL

Intellectual Property & Right of Use
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Compliance with Laws
The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Limitation of Liability
While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy.

The Babystore Ltd cannot be held liable for any errors, omissions or for any action that might be taken as a consequence of following the advice on this website.

The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products.

This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

  • any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  • any loss of goodwill or reputation; or
  • any special or indirect losses, suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance
If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire Agreement
These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what The Babystore Ltd and you are expected to do.

You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions.

Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Law
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

 

Delivery information

Delivery Schedules

Normal delivery is 14-21 working days. Selected products marked ‘in stock’ are manufacturer supplied and delivery schedules may vary, if in doubt please contact us for confirmation prior to placing an order.

All the delivery timescales are estimates.  Our purchasing team will keep you fully updated on the progress of your order via email and our should there be any delays on your delivery.

 

Fraud Checking
Occasionally orders may be delayed due to fraud screening, for example, when the delivery and invoice addresses differ.  You will receive an email or call from our team should your order be affected.  Your order will also be updated via our online tracking facility.

Delivery Charges

Over £100 basket – free to std mainland UK postcodes

Royal Mail

Items dispatched via Royal Mail will be sent 2nd class via a non-tracked method. Due to the nature of this distribution method, please allow up to 7 working days for delivery.  We are not liable for lost or delayed items sent using this method.

Courier
Items are sent on a next day courier service via Interlink Express. Interlink Express delivers parcels between 9am and 6pm Monday to Friday (excluding Bank Holidays) but are unable to give morning or afternoon slots. A signature is required for all Interlink Express deliveries and deliveries cannot be left without a signature. Interlink Express are unable to contact our customers by telephone to advise of delivery times.

What if I’m not in when you deliver?
ALL ITEMS MUST BE SIGNED FOR. We realise that occasionally we may try to deliver an order and you may not be available. Each time an attempt is made, our courier will leave a card “We’re holding an item of mail for you,” at the delivery address confirming that they have tried to deliver with further details. The order will be held for up to two weeks, after which time your items will be returned to our warehouse. If the item is returned to our warehouse, you will incur a charge of £15.00 to cover the returns costs.

Packaging
We may use recycled packaging if the original box has been damaged or for goods received from the manufacturer with multiple pieces in a single carton. Therefore contents may differ to the description shown on the carton. Please check inside for goods ordered. Should the parcel be refused without checking, a £15.00 returns charge will be applicable.

Delivery Locations
We deliver to postal areas in the UK; England, Wales, Scotland and Northern Ireland.

We do ship to the Channel Islands using Royal Mail under the terms stated above.

We can deliver to a BFPO address using Royal Mail under the terms stated above.

We also reserve the right not to deliver orders if we believe the address is not secure, for example, to a communal postal address or PO Box. If this affects an order you place, we will notify you as soon as possible.

Delivery to UK addresses overseas, islands or in remote areas of the UK mainland may take longer than our usual delivery times.

International Delivery
We are unable to ship outside the UK on certain products, for International shipments please contact us for a quote.

Returns

We have a flexible returns policy and will accept goods back if you’ve ordered the wrong item(s), or if you simply find them unsuitable. We require that you return goods unused and packed correctly in their original packaging. Please contact us before sending items back so we can issue you with a returns number. Please remember to enclose your name, address, telephone number and email address, and reason for returning the goods. If you are returning unwanted goods you are liable for the costs incurred in returning them.

Christening items must be returned within 7 days of receipt in their original packaging and with all original labels in place. Christening items received after this time will not be refunded.

Please Note: All goods collected by our courier will incur a minimum charge of £15.00 per box. If you are returning faulty goods this charge will still stand and will only be refunded when said goods are confirmed as faulty by our customer services department and within the manufacturers guarantee.

Damaged Orders on Delivery

If the packaging of your order is damaged, and before you refuse to accept the delivery, check if the contents of the box are damaged. If you find the contents to be damaged, please report this by email thebabystore@live.co.uk for our customer service department to decide on the best course of action to resolve this matter.  Collection charges will apply if delivery is refused unless the product (not the packaging) is faulty/damaged (following verification at the service centre).

Faulty Goods
Please contact us before returning goods as many problems can be solved before items are returned. If the goods need to be returned, a repair, refund or replacement will be offered depending on each individual case. Please contact us before sending items back so we can issue you with returns instructions.

Please Note: All goods collected by our courier will incur a minimum return carriage charge of £15.00 per box. If you are returning faulty goods this charge will still stand and will only be refunded when said goods are confirmed as faulty by our customer services department and within the manufacturers guarantee. Our standard £15.00 per box charge includes carriage back to the consumer. If you return items using your own arrangements we are not liable for lost or damaged items and suggest you use a tracked service with adequate insurance value in place.

 

Cancelling an Order

Under the Distance Selling Regulations, you have a right to cancel your order for any home delivery item for a full refund up to 14 days after receipt of the goods.

If you wish to change or cancel an order please contact us via email at thebabystore@live.co.uk .

We aim to respond to your email within 24 hours of receipt. Please include the following details:

  • Customer name
  • Order number
  • Date of the order

Please note that if you have received delivery of your order we are unable to cancel the order and our normal returns procedure will apply.

If you refuse delivery because you wish to cancel your order but have failed to notify us of your wish to cancel you will be charged based upon the terms of our standard policies, details of which can be found above.

This does not affect your Statutory Rights.

If you change your mind

Within 14 days

Everything we sell online is covered under Distance Selling Regulations by a 14-day cooling off period. Just return the item(s) to us in their original packaging, in a unused, saleable condition, within 14 days from date of receipt, along with the invoice or order number which can be found on your order acknowledgement or delivery packaging, and we’ll give you a refund or exchange.

For Personal Care Products we are unable to offer refunds or exchanges once the product has been washed or used. Packs will only be accepted back if they are complete. This does not affect your statutory rights. Personal Care Products are clearly shown on the listing pages during the purchase process

Please Note: Made to order items and personalised items can only be returned if found to be faulty, when they will be repaired or replaced, refunds will not be issued.

If the product develops a fault

Within 28 days

  • If you wish to return your item(s) within 28 days from the date of receipt, we’ll give you a replacement or a refund, following verification at the service centre. No collection fee is charged
  • If your item is lightweight you may be asked to return the item by post. If this is the case, you will be refunded the postage for second class return.
  • This does not affect your statutory rights
  • This does not cover accidental damage or general wear and tear

Between 28 days – 6 months

  • If you’ve had the product for up to 6 months following the date of receipt, we’ll repair the product or, if that’s not possible, give you a replacement or, if that’s not possible, a refund. No collection fee is charged
  • If your item is lightweight you may be asked to return the item by post. If this is the case, you will be refunded the postage for second class return
  • This does not affect your statutory rights
  • This does not cover accidental damage or general wear and tear

6 months +

  • If you’ve had the product for more than 6 months following the date of receipt, we can obtain a quote from the manufacturer for repair

 

Refund Procedure
We will initiate the refund, replacement or exchange process once we have been notified of your request. If we have arranged the collection on your behalf, we will issue a refund less the applicable collection charges back to your card account.

Refunds are made to the original payment card.

Any payments made by PayPal will be refunded via PayPal.

Any refunds due to the customer will be processed within 30 days by The Babystore Ltd, as per Distance Selling Regulations.

Packaging Procedure for Returning an Item

Please can you ensure your order is boxed securely and tape an envelope to the outside of the box containing your invoice and reason for return. If you do not have your invoice please include your name, address, order number and reason for return.  Please write the following address on the outside of the envelope:

How to make a Payment

How can I pay for an order?
We offer various ways for you to pay for your order online. You can do so using any of the following:

  • Mastercard
  • Visa
  • Visa Delta
  • Visa Electron
  • PayPal

We do not accept the following:

  • American Express
  • Diners Card
  • Electron Cheques
  • Personal Cheques

All prices shown on the website are in Pounds Sterling

Is it safe to give my credit/debit details online?

We realise how important it is to store any information that you provide securely. The Babystore Ltd maintains the highest levels of security. We use SagePay as our Payment Service Provider. SagePay VSP Server is a secure third party. Credit/Debit card details are secured within 128-bit encrypted sessions. Sensitive information is stored on a heavily encrypted database that is protected by multiple govenment approved firewalls. You can therefore rest assured that we take the privacy and security of your payment and personal details very seriously.

We also perform Address Verification and Card Verification as well as random Telephone Verification to prevent fraud.

To increase the security of Internet transactions Visa and Mastercard have recently introduced 3D-Secure (like an online version of Chip and PIN). Depending on the card you’ve chosen to use and the retailer from whom you are purchasing, when you click Proceed you may be asked by your card issuer for further authentication.

When will my account be debited?
Once you have placed your order, your nominated account will be debited immediately and you will be sent an email to confirm your order.

How do I get an invoice?
The prices quoted on our website include VAT on items where it is levied and an invoice will be sent out to you with your order.

If your order is delivered directly from our distributors or a separate delivery address has been specified, an invoice will not be sent unless requested

 

FAQ’s  

I have placed an order online and it was on 14-21 Working Day Delivery, how long will it take?

Standard delivery is 14-21 working days. You will be contacted by email if we feel that your order is likely to take longer than this period. If you have had no emails and it has been longer than this time, please contact us via email to thebabystore@live.co.uk (please include your order number in the email). We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday). 

I have placed an order online and my delivery is incorrect
Firstly, we ask that you check inside the box as we may use recycled packaging if the original box has been damaged or for goods received from the manufacturer with multiple pieces in a single carton. Therefore contents may differ to the description shown on the carton.
If you have been delivered the incorrect item, please contact us via email to thebabystore@live.co.uk (please include your order number in the email). We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday).
I have received my order but the packaging is damaged
We would ask that before you refuse to accept the delivery you check if the contents of the box is damaged. If you find the contents to be damaged then please contact us via email at thebabystore@live.co.uk (please include your order number in the email). We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday). Collection charges will apply if delivery is refused unless the product (not the packaging) is faulty/damaged (following verification at the service centre).

I have cancelled an order, how long will my refund take?
Any refunds due to the customer will be processed within 30 days of receipt of the goods by The Babystore Ltd, as per Distance Selling Regulations.

I have placed an order online and would like to change my details
If you find on your order confirmation that you have entered your details incorrectly, please contact us via email at thebabystore@live.co.uk (please include your order number in the email). We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday).

I tried to place an order online and had problems with my payment

If you experience difficulties with your payment please ensure that you are doing the following:

  • On the payment page, the name on the card must be the same as written on the card
  • The address and postcode must be the address that the card is registered to – identical to the one on your bank/credit card statement

I would like to return a product

Please see our Returns policy to arrange the return of your order or contacting us via email at thebabystore@live.co.uk. We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday).

Gift vouchers cannot be returned.

I would like to report a fault
Please report any problem you are experiencing with your purchase by contacting us via email at thebabystore@live.co.uk. We aim to respond to your enquiry within 24 hours of receipt (Monday – Friday).

I have returned an item, how long will my refund take?
We will initiate the refund, replacement or exchange process once we have been notified of your request. If we have arranged the collection on your behalf, we will issue a refund less the applicable collection charges back to your card account.

Any payments made by PayPal will be refunded via PayPal.

Any refunds due to the customer will be processed within 30 days of receipt of the goods by The Babystore Ltd, as per Distance Selling Regulations.

Do you price match?
We will do our best to match prices, please send copies of quotes to store or email.

How do I buy Emmaljunga or Joolz products online?

These items can only be purchased instore.
